Terms of Service

These Terms of Service (“Terms”) govern access to and use of the Flo∞ platform, websites, mobile apps, and related services (the “Service”), operated by a company established in the United Arab Emirates. By signing up or using the Service, the business and the individual accepting these Terms on its behalf (“you”) agree to be bound by them. If you do not agree, do not use the Service.

You must provide accurate account information and keep it current. You are responsible for safeguarding your login credentials and for all activity under your account, including the actions of team members you invite. You confirm you are authorised to enter into these Terms on behalf of your business.

• Flo∞ is offered on paid subscription plans. Plan features and seat allowances are described on our pricing page and in your order.
• Fees are billed in advance on a recurring basis through our payment processor (Stripe). Additional seats and usage-based features are billed as described at sign-up.
• Unless stated otherwise, subscriptions renew automatically for successive periods until cancelled.
• You can cancel renewal at any time; cancellation takes effect at the end of the current billing period.

TODO (owner): confirm and state refund policy, taxes/VAT handling, currency, price-change notice period, and any trial terms with counsel.

You retain all rights to the data and content you and your end customers put into Flo∞ (“Customer Data”). You grant us a limited licence to host, process, and transmit Customer Data solely to provide and improve the Service and as described in our Privacy Policy.

You are responsible for the Customer Data you store — including having a lawful basis to collect and process your end customers’ personal data, and for the accuracy of that data. As between you and us, you are the controller of your end customers’ data and Flo∞ is your processor.

You agree not to:

• Use the Service to break the law, infringe others’ rights, or send unlawful, harassing, or unsolicited messages (including non-compliant SMS/WhatsApp/voice outreach).
• Upload malware, attempt to gain unauthorised access, or disrupt or overload the Service.
• Reverse-engineer, resell, or sublicense the Service except as expressly permitted.
• Misuse the AI features — for example to generate unlawful content or to impersonate others deceptively.

You are responsible for complying with telecom and messaging rules and for obtaining any consents required to contact your end customers.

Flo∞ uses AI to assist with booking, messaging, reordering, and a phone receptionist. AI output can be incomplete or incorrect. You are responsible for reviewing AI-assisted actions where appropriate, and you should not rely on the Service for professional (e.g. medical, legal, or financial) advice. Features and autonomy settings are configurable, and you control which actions Flo∞ takes on its own.

The Service integrates third-party providers (such as Supabase, Stripe, Twilio, Retell, Anthropic, Resend, and Sentry). Your use of those features may be subject to the providers’ own terms, and we are not responsible for third-party services we do not control.

The Service, including its software, design, and trademarks, is owned by Flo∞ and its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. No rights are granted except as expressly stated.

We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features, and we may perform maintenance that temporarily affects availability.

The Service is provided “as is” and “as available”, without warranties of any kind except as required by law. To the fullest extent permitted by applicable law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by applicable law, neither party is liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Our total aggregate liability arising out of or relating to the Service is limited to the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim.

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate access if you materially breach these Terms, fail to pay, or use the Service in a way that creates legal or security risk. On termination, your right to use the Service ends, and we handle your data as described in our Privacy Policy.

We may update these Terms from time to time. When changes are material, we will update the “last updated” date above and, where appropriate, notify account holders. Continued use of the Service after an update means you accept the revised Terms.

These Terms are governed by the laws applicable to our place of establishment in the United Arab Emirates, without regard to conflict-of-laws rules.
